Man accused of killing nine people in Pienaar denied bail

Bongani Patrick Nkosi (39), accused of murdering nine people in the devastating Pienaar tavern mass shooting, has been denied bail by the Kabokweni Magistrate’s Court.

During the bail hearing, which was prolonged from Wednesday to Friday, February 12-14, the court ruled that Nkosi failed to provide exceptional evidence to warrant bail for this serious offense.

The court’s decision came after Investigating Officer, Sergeant Nkambule testified that releasing Nkosi would compromise the safety of witnesses and the community.

“Witnesses and community members are adamant that he should not be granted bail, as they fear for their safety. They are relying on the justice system to take its course,” Nkambule explained.

The investigating officer also expressed concerns that the accused might intimidate witnesses, who reside in the same area, to prevent them from testifying during the trial. Furthermore, he disputed Nkosi’s claim of self-defense, stating that the evidence suggests a deliberate intent to kill.

In contrast, Nkosi’s legal representative, Nkosingiphile Maluka, argued that his client’s life was in danger and that he acted in self-defense. Maluka also alleged that some of the victims had a history of terrorising the community.

The accused was arrested following the mass shooting, which occurred on January 11 at the Levisa Tarven, claiming the lives of nine people. Six people died on the scene, three others succumbed to their injuries in hospital, and one survivor was left injured and still recovering.

Magistrate Nandi Mhlanga emphasised the severity of the case, stating, “We are dealing with a serious case that resulted in multiple fatalities, and the accused failed to provide exceptional evidence to warrant bail.”

Nkosi will remain in custody until his next court appearance on March 28, facing nine counts of murder, attempted murder, and defeating the ends of justice.
