Nkwanyana was charged with three counts of fraud, forgery and uttering. The court found her guilty of fraud and uttering. She submitted a fake matric certificate when applying for the position of senior administrative officer in 2006. The Public Service Commission conducted an internal investigation. The investigation found Nkwanyana guilty and was charged.

She was arrested on February 26, 2021, and was released on R3 000 bail. The state had four witnesses while the defence had one witness. On August 8, 2021, the court found that the evidence presented by all four state witnesses was credible and admissible. Meanwhile, the evidence from the defence was not credible.
